Regulatory Compliance Requirements

In Jefferson County, a Use Permit is generally required prior to closing on the sale of a property served by an Onsite Wastewater Treatment System (OWTS).

A Use Permit is typically required if:

  • The septic system or any component is more than 5 years old
    • The property is being transferred in a covered real estate transaction
    • The system includes mechanical or advanced treatment components

The Use Permit application generally requires:

  • Inspection by a qualified/certified inspector
    • Pumping documentation (if required)
    • Confirmation that the system is functioning as designed
    • Submission of required county forms and fees

If a system was installed and approved within the past 5 years, a Use Permit may not be required — but this should be confirmed before listing.

 

Short-Term Rental (STR) Septic Requirements – Jefferson County

Jefferson County has updated its short-term rental (STR) regulations to include septic system requirements for properties served by Onsite Wastewater Treatment Systems (OWTS).

If a property in unincorporated Jefferson County is operated as a short-term rental, annual septic inspection and pumping may be required as part of STR permitting and ongoing license compliance.

This requirement is separate from the traditional transfer-of-title Use Permit process required during property sales.

Realtors and property owners should confirm:

  • Whether the property is served by septic (OWTS)
    • Whether annual inspection and pumping documentation is current
    • Whether STR licensing requirements have been satisfied

Failure to maintain required septic documentation may delay STR permit approval or renewal.

  2. Determine system age and whether a Use Permit is required.
